VI设计公司员工岗位保密工作规范及准则


根据《中华人民共和国劳动法》和《深圳经济特区劳动合同条例》及其他有关法律法规的规定,甲乙双方本着平等自愿、协商一致的原则,达成如下协议:

甲方(用人单位):

乙方(员工):

一、 甲方对乙方的行为规范要求:
1、 员工敬业及合作精神要求:
1) 乙方在任何时候都要将实现甲方的最大利益作为自己行为准则。乙方的行为不能对甲方公司的工作氛围产生负面或不良影响。
2)VI设计公司 乙方需严格执行公司制定的所有规章制度,并承担所有违章责任。
3) 乙方应努力履行自己的职责以及上级管理人员交给的其他任务。公司倡导员工之间的合作与相互支持,员工应该以礼貌及合作的态度对待同事及来访者。
4) 乙方应在第一时间以信任的态度与其相关上级管理人员或合作的同事就发生在工作中的任何问题进行讨论,而非与公司以外的任何人讨论这些问题。
5) 乙方不得利用自己的职务谋取不当利益。
6) 如甲方确因经营需要或因乙方的能力及表现,可变更乙方的工作范围及职责,或将乙方的客户及案源资讯转移他人负责,乙方有反映本人意见的权利,但未经甲方批准,必须服从。
2、 工作行为规范准则:
1) 上班时间必须充分利用于工作上,任何员工都不得占用工作时间来处理私人事物。唯有工作资料可以放在办公室,私人文件和资料都不得存于办公室内。
2) 工作时间内严禁在办公室玩电脑游戏、浏览与工作无关的网站或阅读与工作无关的资料、书籍。发现一次,罚款伍拾元整。
3) 乙方需自觉保护公司的设备、工具和用品,同时应该节约使用公司的设备和办公用品、工具,除特殊规定的使用外,公司的设备和工具只能用于与工作有关部门的目的。乙方对其故意造成的任何办公设备、用品的损失或损坏都负有赔偿责任。
4) 乙方应积极完成上级管理人员交托的任务,如未能完成任务又不予以合理解释的,公司可按怠职处理。业务和工程人员需每周五上交工作报告给部门主管,以便主管了解情况来安排下周工作。

二、 甲方对乙方的商业保密要求:
1、 甲乙双方约定,乙方同意在受雇甲方服务期内,乙方对所有甲方只商业机密负有保密责任,甲方具体商业秘密保密事项如下:
1) 甲方的业务秘密,包括商品产、供销渠道,客户名单、名片,买卖意向,成交或商谈的价格,商品性能、质量、数量、交货日期。
2) 甲方的经营秘密,包括经营方针,投资决策意向,产品服务定价,市场分析,广告策略。
3) 甲方的管理秘密,包括财务资料、人事资料、工资薪酬资料、物流资料。
4) 甲方的技术秘密,包括由乙方跟进的所有工作内容及资料。如:SOURCE CODE、SCHEMATIC、PCB LAYOUT 等。若资料需给客户,必须CC给工程主管人员。公司内部人员若需技术资料可向工程主管人员申请。
2、 乙方所涉及有关部门甲方公司之作业流程,作业方式及与作业相关之资讯信息、客户讯息等均属甲方之商业机密,乙方不得以任何方式对外泄露。
3、 乙方在签订劳动合同后不得向任何其他人或实体使用任何与公司的经营方式或业务有关信息及文件、公司客户名单、公司提供服务的价格,一旦甲方发现乙方有上述任何一种行为,即视为乙方违反了本合同之保密条款之约定,乙方应赔偿甲方人民币伍万元整,若因此而给甲方造成经济损失或其他损失的,甲方可依法予以追究、索偿。

三、 本协议一式两份,甲乙双方各执一份。经双方确认签字盖章后立即执行生效。
